Real estate video drones now legal!

Our all-knowing, all seeing and over regulating government took a setback this week when a judge dismissed the FAA’s case against the first-ever person charged with flying a model drone commercially. The FAA has stated that flying an aerial drone for commercial purposes was the legal in the USA. They also stated that there was “no gray area” in the law to allow commercial drone use.
So, when a 29-year-old, used a drone to film a commercial at the University of Virginia, the FAA attempted to levy a $10,000 fine against him. Instead of just laying down and paying the fine or trying to plead for a lesser amount, the drone owner hired an attorney and fought the FAA.

Patrick Geraghty, a judge with the National Transportation Safety Board, ruled this week that there are no laws currently against flying the drone commercially. Geraghty said: The FAA “has not issued an enforceable Federal Acquisition Regulation regulatory rule governing model aircraft operation; has historically exempted model aircraft from the statutory FAR definitions of ‘aircraft’ by relegating model aircraft operations to voluntary compliance with the guidance expressed in [the 2007 policy notice], Respondent’s model aircraft operation was not subject to FAR regulation and enforcement.”

So for now, if you’ve been considering adding another marketing tool to your arsenal to stay on top of real estate technology, a real estate video drone is at the moment, fully legal in the USA! Now, with that said, there is always a possibility that the FAA could try to institute some new rule to regulate drones.
